Generative AI has moved from novelty to systemic infrastructure faster than any other technology since the semiconductor. The core challenge is not that AI is dangerous by default, but that it is scaling on exponential curves while institutions scale on linear ones. Models that would have required supercomputers in 2020 can now be trained by mid-tier labs.

As capability jumps every 6–12 months, we are left with a new structural mismatch: regulation is still constrained to multi-year cycles of debate, drafting, consultation, and enforcement. Governance is inherently retrospective. AI is explosive and forward-propulsive.

Regulation written for yesterday’s models
Europe’s AI Act was conceived in a pre-GPT era. By the time it passed, the field had shifted to multimodal agents that can browse, plan, and execute.

In the U.S., executive orders create reporting thresholds, but those thresholds assume models are static.

China’s registry approach is faster but it is built around political order, not safety engineering. Governance loops simply cannot keep up with capability shift velocity.

AI compliance today is paperwork, not physics
The uncomfortable truth: most AI compliance today is PDFs and documentation, not enforcement tied to compute reality. Governance needs to move to telemetry, that is, live oversight and not post-facto risk memos. Because ethics cannot be a PDF, ethics must be a runtime constraint.

What needs to change
There are three shifts that can narrow the gap:

  1. Continuous regulation, not episodic
    Frontier compute should be auditable like nuclear materials in real time. Continuous evaluation pipelines could flag misuse and detect emergent dangerous capabilities as they happen.
  2. Outcome-based standards, not procedural checklists
    Regulators should focus on behavioural outcomes like disinformation throughput, dual-use risk, autonomous cyber capabilities and not compliance paperwork.
  3. AI safety as an institution, not a research niche
    Independent safety labs should be funded and governed like central banks, with enforcement powers and not advisory powers.

Why this decade matters more than any decade before
We are early enough that guardrails can still shape the slope of adoption, but late enough that capability jumps can impact geopolitics, markets, identity infrastructure and synthetic media at population scale. If governance does not catch the curve now, it never will.

To sum up, the trajectory needs to be regulated instead of regulating the past.
